Southampton City Council's crossover terms and conditions, last updated 17 August 2026, state that "only contractors who are accredited under the New Roads and Street Works Act 1991, and who hold 10 million pounds public liability insurance, may apply for a licence", and that "contractors must seek permission to excavate in the public highway by completing a Road Opening Licence".
The same document sets the conditions a drive has to be designed around. It states that "the construction of your proposed vehicle crossover must not adversely affect highway drainage, and/ or increase the risk of flooding"; that "if you wish to lay a new driveway, you must make sure it has proper drainage and that water will not spill out on to the highway. If you are going to have a driveway surfaced with concrete, some types of tarmac, brick paving or other non-porous material, you will need to make sure there is a drain on your property for any surface water"; that "if you live on a classified road, an A, B or C road, you will require planning permission"; and that "to prevent damage to the newly constructed vehicle crossover, the works to the driveway/parking area must be carried out prior to the construction of the vehicle crossover".
On heritage the council states that there are 20 conservation areas in Southampton and that inside one "we have extra controls over a number of factors", including demolition, construction and the protection of trees. The Portswood Residents Gardens Article 4(2) direction lists, among its classes, "the provision, within the curtilage of a dwellinghouse of a hard surface for any purpose incidental to the enjoyment of the dwellinghouse as such (including paths and hardstandings)" and "the erection, construction, improvement, alteration or demolition of a gate, fence, wall or other means of enclosure", where the development would front a highway, waterway or open space.
The national front garden rule is on the Planning Portal. An eligible house with the relevant permitted development rights may be paved with permeable surfacing or drained to a lawn or border without an application, and impermeable paving over five square metres needs permission where it does not drain to a permeable area.
