The rules that change a drainage job in Darlington

Darlington Borough Council states on its own drains and sewers page that Northumbrian Water Limited took responsibility for all shared drainage on 1 October 2011, that Northumbrian Water unblocks shared private drains and sewers, and that the council is responsible for flooding from roads and public drains.

The transfer on 1 October 2011 covered qualifying private sewers and lateral drains connected to the public sewer system by 1 July 2011 (gov.uk, the private sewers transfer regulations). Responsibility for an individual pipe should be checked with the sewerage undertaker, which here is Northumbrian Water.

Northumbrian Water requires its consent where there is a public sewer within three metres of proposed work, and sets out a building over agreement covering liability and rights of access to repair the sewer. On the planning side the council labels flood zone 3 "Significant Risk" and flood zone 2 "Moderate Risk", with the remainder "low risk and labelled zone 1", and says a flood risk assessment should accompany applications in those zones and is normally mandatory for developments over one hectare.
