The rules that change a drainage job in King's Lynn

The Borough Council of King's Lynn and West Norfolk states that a flood risk assessment must be submitted where the property or site is at risk of flooding, or the development is one hectare or more in size. In zone two it states that a full flood risk assessment is not required for developments of less than one hectare, unless the site is shown to be at risk due to the impacts of climate change, is at residual risk from the failure or overtopping of existing defences, or is at risk of flooding from another source, and it directs applicants to the standing advice on GOV.UK.

The transfer on 1 October 2011 covered qualifying private sewers and lateral drains connected to the public sewer system by 1 July 2011 (gov.uk, the private sewers transfer regulations). Responsibility for an individual pipe should be checked with Anglian Water.

Anglian Water states that planning consent does not grant approval to build over or within three metres of a public sewer, that building over pumped or rising mains is not permitted under any circumstances with three metres of clearance required on both sides, and that where a proposal cannot meet all of the published criteria an application for a build over agreement must be made. Alongside it the King's Lynn Internal Drainage Board, part of the Water Management Alliance, states that watercourses within the drainage district are generally the responsibility of riparian or private owners to maintain unless vested in another authority.
